Résumé: تعتبر الشهادات الطبية الكاذبة من ابرز المخلفات والتجاوزات الشائعة المرتكبة من طرف الأطباء ومقدمي العلاج، حيث أنها تمنح امتيازات مادية غير مبررة للغير على حساب المستخدمين ومؤسسات العمل ولاسيما هيئات الضمان الاجتماعي وكل من له صفة المؤمن اجتماعيا لما يترتب عليها من نفقات زائدة تمس بالتوازنات المالية لصناديق الضمان الاجتماعي، والمشرع الجزائري في إطار مكافحة ظاهرة الشهادات الطبية الكاذبة اوجد نوعين من الرقابة، مراقبة قبلية تتجسد من خلال الرقابة الطبية وكذا الرقابة الإدارية ومراقبة بعدية تمارس في إطار القانون 08-08 المتعلق بالمنازعات في مجال الضمان الاجتماعي تتجسد من خلال لجنة تقنية ذات طابع طبي باعتبارها آلية للتسوية غير القضائية، وكذا من خلال تكريس المتابعة الجزائية كآلية ردعية تضمن معاقبة وردع كل من يتجرأ ويصر على إصدار شهادات طبية كاذبة من شأنها تحميل صناديق الضمان الاجتماعي مصاريف زائدة وبدون وجه حق. Abstract: False medical certificates are among the most common waste and abuses committed by doctors and treatment providers, as they grant unjustified material benefits to others at the expense of users and labor institutions, in particular social security organizations and all socially insured persons, resulting in excessive expenses affecting the financial balances of the security funds And the Algerian legislator, in the context of combating the phenomenon of false medical certificates, has created two types of supervision: tribal control, which is embodied through medical supervision, administrative control and remote control, which are exercised under Law 08-08 on disputes in the field of Social Security is embodied through a committee of a medical nature of technology as a mechanism for the settlement of non-judicial, as well as through the consecration of criminal follow-up mechanism dissuasive ensure that punish and deter anyone who dares insist on medical certificates false version will download the social security funds redundant expenses and unlawfully.
