التكييف القانوني لعقد الاعتماد الإيجاري

Résumé: ملخص المذكرة : تعد عملية تكييف أي نضام قانوني جديد يكون إما بإدخاله ضمن طائفة العقود الشائعة وتقريبه منها، أو باعتباره نضاما مركبا من عدة عقود تقليدية، أو بالاعتراف له بكيان خاص و طبيعة مستقلة، ومن هنا توصلنا إلى أن عقد الاعتماد الايجاري عبارة عن نضام جديد له كيانه المستقل والمتميز عن غيره من العقود والتصرفات المشابهة، بحيث يجمع بين طياته خصائص العديد من العقود والتصرفات، لكنه يستقل عنها و لا يمكن إضفاء طابع أي منها على هذا العقد، كما أن هذا العقد يتمتع بخصائص معينة تساهم في إبراز الطبيعة الخاصة للعقد. وقد اختلفت الاتجاهات الفقهية في شان تكييف عقد الاعتماد الايجاري إلا أن التشريع و القضاء استقرا على تكييفه قانونا على انه عقد إيجار ذا طبيعة خاصة، وبالتالي تطبق عليه أحكام عقد الإيجار العامة إلا ما يتعارض منها مع الطبيعة المالية للعقد،خاصة على صعيد دور المالي الذي يلعبه المؤجر في هذا العقد . Summary: The process of adapting any new legal entity is either by entering it within the range of common contracts and by bringing them closer to it, as a complex undertaking from several conventional contracts, or by recognizing it as a private entity and an independent nature. Hence, we conclude that the lease contract is a new undertaking with its own independent entity And distinguished from other contracts and similar actions, so that it combines the characteristics of many contracts and actions, but it is independent and can not be assigned any of them this contract, and that the contract has certain characteristics contribute to highlight the special nature of the contract. The jurisprudential trends differed as to the adaptation of the rental contract, but the legislation and the judiciary relied on its legal adaptation as a lease of a special nature. Accordingly, the provisions of the general lease contract apply only to the financial nature of the contract, especially in terms of the financial role it plays Lessor in this contract.
