تسوية النزاعات أمام هيئات الضبط المستقلة

Résumé: سحب المشرع الجزائري صلاحية حل بعض النزاعات الاقتصادية من القاضي و منحها لبعض هيئات الضبط المستقلة ، وذلك لاعتبارات عدة أهمهما الكفاءة والتخصص وسرعة الفصل، لكنه بالمقابل لم يبين أو بالأحرى لم يوحد الطبيعة القانونية لهذا العمل الذي تضطلع به هذه الهيئات ولا طبيعة القرارات الفاصلة في هذه النزاعات ، وهو ما سنحاول دراسته في هذا العمل من خلال الإشكال التالي: ما هي القواعد التي اعتمدها المشرع في إسناد اختصاص حل النزعات لهيئات الضبط المستقلة؟ ومن خلال استقراء مختلف النصوص المنظمة لهذه الهيئات نسجل انتقاء لها من قبل المشرع فليس كل هيئات الضبط حضيت بسلطة تسوية النزاعات، مع تضارب في آليات وإجراءات هذه التسوية. The Algerian legislator withdrew the authority to resolve some economic disputes from the judge and granted it to some independent control bodies, for several considerations, the most important of which are efficiency, specialization and speed of settlement, but in return he did not clarify, or rather did not unify the legal nature of this work undertaken by these bodies, nor the nature of the decisive decisions in these disputes. , which we will try to study in this work through the following problem: What are the rules adopted by the legislator in assigning the competence to resolve disputes to independent regulatory bodies?
