خراب الحبس والأحكام الشرعية المترتبة عليه Mortmain Devastation And The Legal Provisions Resulting From It

Résumé: تتعرض العقارات المحبسة إلى عوامل عديدة تحول دون تحقيق الانتفاع بها، فتتعطل وتخرج عن المقصد الأصلي منها الرامي إلى الحرص على الدر الدائم الموجب للثواب والأجر الدائمين، فقد فاتت المصلحة من استغلال أحباس كثيرة كانت منابع خير تصب في أوعية الحياة الإنسانية سدا لحاجيات المجتمع، ووقوفا على سبل تحضّره، بعد أن صارت رمادا تذروه الرياح. وفي هذا البحث سلط الضوء على خراب الحبس وأسبابه، وعلى الأحكام الشرعية المترتبة عليه، فتبين أن الشريعة الإسلامية كما حرصت على حفظ الأحباس وإن كانت خرِبة، حرصت على إيجاد سبل لتحصيل المنفعة منها، فحققت بذلك التوفيق بين عنصرين جوهريين في مقصد التحبيس هما: الإبقاء على الأحباس، وتحقيق الانتفاع بها. Endowed real estates are exposed to several factors which might well block guaranteed benefits, prevent people to gain perpetual divine rewards, and eventually restrain the society’s development. The current study sheds light on the causes that lead to ruined estate and the undertaken legal provisions. The Islamic law does not only endeavor to retain the endowed estate, even the ruined, but how to get interest from it as well. In this sense, preserving the seized estate and making benefit from are two major elements in endowing real estate.
