: المسؤولية المترتبة عن قرارات التحكيم الصادرة عن السلطات الإدارية المستقلة "دراسة مقارنة"

Résumé: تتمتع بعض السلطات الإدارية المستقلة في النظام الفرنسي وأيضا في النظام الجزائري بصلاحية التحكيم بين الاطراف المتنازعة، وتصدر بخصوص هذه الصلاحية قرارات تحكيمية، غير أنها قد تكون هذه القرارات غير مشروعة أو تسبب ضررا، ما يتعين مساءلة السلطة الإدارية المستقلة عن هذه القرارات ولاسيما عن طريق تقرير مسؤوليتها عنها. وتقوم مسؤولية السلطات الإدارية عن قرارات التحكيم إما على أساس الخطأ، وذلك إذا توافرت أركان المسؤولية المتمثلة في الخطأ، والضرر، والعلاقة السببية بينهما. كما تقوم مسؤولية السلطات الإدارية المستقلة بدون خطأ، إذا توفر ركن الضرر وعلاقته بالتصرف المشروع الصادرة عن السلطة الإدارية المستقلة والمتمثل في قرار التحكيم. Abstract : Someindependent administrative authorities in the French system and also in the Algerian system have the power to arbitrate between the conflicting parties, and arbitration decisions are issuedregardingthisauthority, but thesedecisionsmaybeillegal or cause harm, so the independent administrative authority must beheldaccountable for thesedecisions, especially through a report. Herresponsibility. The responsibility of the administrative authorities for arbitration decisionsisbasedeither on the basis of error, and that is if the elements of responsibility of the error, the damage, and the causal relationship between them are available.
