جريمة إصدار شهادة تصديق إلكتروني بدون ترخيص دراسة على ضوء القانون رقم 15/04 المتعلق بالتوقيع والتصديق الإلكترونيين.

Résumé: نظرا لما تحظى به شهادة التصديق الإلكتروني من أهمية قصوى في مجال المعاملات الإلكترونية، والتي هي عبارة عن بطاقة هوية إلكترونية صادرة عن جهة موثوقة تثبت الصلة بين المفتاح العام وصاحب التوقيع الإلكتروني، والتي على أساسها وأساس صحة البيانات المدونة فيها يقدم المتعاقدون على التعاقد مع صاحبها، فقد جرم المشرع الجزائري بموجب القانون رقم 15/04 المحدد للقواعد العامة المتعلقة بالتوقيع والتصديق الإلكترونيين فعل إصدارها دون الحصول على ترخيص من السلطة الاقتصادية باعتبارها السلطة المخولة لها إصدار شهادات التصديق الإلكتروني في الجزائر، وذلك نظرا لما يرتبه هذا . .لفعل من آثار خطيرة في حق الغير. Abstract: By the Importance of the electronic certification of ratification in the field of electronic transactions which is on electronic identity card issued by trusted authority that establishes the link between the public key and owner of the electronic signature on the basis of which the validity of the data recorded the contractors to contract with its owner. The Algerian legislation was forbidden according to law n 15/04 defining the general rules related to electronic signature and ratification so, it must be issued without obtaining a license from the economic authority, as it is the authority entitled to issue electronic ratification certification in Algeria, there for this act is behind a dangerous effects of the right of others.
