الحماية الاستثنائية للمستهلك بين الإفراط وحتمية عدالة التعاقد - دراسة مقارنة

Résumé: يُعد هاجس حماية المستهلك المحرّك الأساسي لكافة التشريعات في توجّهها نحو تكريس معالم حماية أكبر وإقرار حقوق أوسع له. ويشكل خيار المستهلك في العدول عن العقد وحمايته من أي شرط مضر به عند التعاقد أبرز أوجه الحماية وتكريس الحقوق التي تناولتها بعض التشريعات دون بعض. ذلك أن حظر الشرط المضر بالمستهلك يعد خطوة جريئة لحماية المستهلك أورده القانون الإماراتي لحماية المستهلك ولم تتضمنه غالب تشريعات الاستهلاك. كما أن خيار المستهلك في العدول عن العقد يعد هو الآخر جانبا لا يقل أهمية من جوانب تعزيز الحماية المطلوبة للمستهلك بضمانات وجزاءات كافية. ومن تم يرصد البحث نتائج واقعية بشأن حدود وآثار وضمانات ميزتي حظر الشرط المضر بالمستهلك وكذا خياره في العدول عن العقد، ضمن دراسة تحليلية نقدية مقارنة بين قوانين حماية المستهلك الجزائري، والإماراتي، والفرنسي، والكويتي، والمصري. The concern for consumer protection is the main driver of all legislation in its orientation towards establishing greater protection features and the adoption of broader rights for it. The consumer’s choice to abandon the contract and protect it from any harmful condition when contracting is the most prominent aspect of protection and enshrinement of the rights that some legislations dealt with without others. The ban on the condition harmful to the consumer is a bold step to protect the consumer mentioned in the UAE Consumer Protection Law and not included in most consumer legislation. The consumer's choice to abandon the contract is also an equally important aspect of enhancing the protection required for the consumer with adequate guarantees and penalties. The research monitors realistic results regarding the limits, effects, and guarantees of the two advantages of banning the condition harmful to the consumer, as well as his choice to abandon the contract, within a critical analytical study compared to the Algerian, Emirate, French, Kuwait, and Egyptian consumer protection laws.
