قاعدة الضرورات تبيح المحظورات وتطبيقاتها في الفروع الفقهية -نماذج مختارة-

Résumé: تناول هذا البحث قاعدة الضرورات تبيح المحظورات وتطبيقا نماذج مختارة- وقد جاء في مقدمة البحث الإشكالية التالية ما مدي تأثير القاعدة على الأحكام الشرعية، وإلى أي مدى يمكن استباحة الضرورة حال تعلقها بالمحظور؟ وثلاثة مباحث وخاتمة وكان المبحث التمهيدي معني قاعدة الضرورات تبيح المحظورات والمبحث الأول حول أدلة قاعدة الضرورات تبيح المحظورات وأهميتها وضوابطها والمبحث الثاني في ما يخص مجال التطبيقي للقاعدة عرضنا فيه نماذج من المسائل مختلفة تحققت فيها الضرورة وبذلك توصلنا في الخاتمة إلى أن الضرورة الشرعٌة وإن ا ضبطت بقيودٌ يجب اعتبارها وعدم 􀁢 كانت سببا لإباحة المحظور في أحوال كثٌرة إلا أ ا إن لم تؤخذ بعين الاعتبار يؤدي إلى انحراف العمل تحت مسمى الضرورة، 􀁢 إهمالها لأ وما نوصي به هو توعية الناس بفقه الضرورة والضروريات، والاهتمام بفقه الضرورة على المستوى العلمي نظريًا وتطبيقيًا، لكثرة الفروع والتطبيقات التي ترجع إلى تقدير الضرو رة مع ما تواجه المسلمين من تحديات. Summary This research intook the rule of the saying that says ‘‘necessity knows no laws’’ and applying it in the jurisprudence branches ,in the introductory of this research lies the following problematic: what is the impact of the previously mentioned rule on sharia provisions? and to what extent shouldwe permit the prohibited deedsunder the pretext of necessity? in addition to three studies and conclusion, the preliminary study was about the precept of the saying ‘‘necessity knows no laws’’ ,and the headmost study is about the evidences as well as testimonies of the saying ‘‘necessity knows no laws’’ with regard to its regulations and significances, and the second study, in terms ofthe applied side of the rule, we reviewed some models of varied issues in which necessity was achieved. Based on that we came out with a conclusion that the legitimate necessity even if it was a reason to permit the prohibited deeds in many cases, it still bounded with regulations taking them into consideration is compulsory, because if once the regulations has been neglected, leads to the deeds deviation under the pretext of necessity. as we recommend spreading awareness about the essence of necessity and necessities, and giving more importance to the jurisprudence of necessity scientifically, theoretically and practically, for it has a varied offshoots and implementations that are due to necessity, and with the challenges that are challenging muslims day by day.
