العقد والقرار الإداري في ظل ضابطي المشروعية والامن القانوني

Résumé: تهدف هذه الدراسة الى تسليط الضوء على القرار والعقد الإداريين، في ظل مبدأي المشروعية والأمن القانوني، وذلك من خلال محاولة تبيان الاحكام والقواعد اللازم اتباعها من الإدارة لتحقيق فعالية النشاط الإداري، والحفاظ على حسن سير المرفق العام، مع تكريس دولة الحق والقانون، في مقابل الحفاظ على الحقوق المكتسبة. The current study aims at shedding the light on the administrative decision and contract in the light of the principles of legality and legal security. This is done through trying to clarify the necessary previsions and rules to be followed by the administration in order to fulfill the effectiveness of the administrative activity, as well as to maintain a better functioning of the public facility. In addition to the consecration of a state of rights and law, and in return, preserving the acquired rights.
