The Legal Framework Of Economic Real Estate In Accordance With Law 23-17

Résumé: The economic real estate is an important element in the investment process as it is the vessel on which the investment project will be embodied. It has long been considered one of the most important obstacles facing the investment file in Algeria, despite the importance given to it by organizing it with an arsenal of sequential legal texts, up to Law 17-23, which determines the conditions and methods of granting the economic real estate belonging to the private property of the state directed to the completion of investment projects.Through which the legislator reorganized the economic property by defining its concept and limiting its scope, as well as the bodies entrusted with its management and preparation يشكل العقار الاقتصادي عنصرا هاما في عملية الاستثمار باعتباره الوعاء الذي سيجسد عليه المشروع الاستثماري وطالما اعتبر أحد اهم المعوقات التي واجهت ملف الاستثمار في الجزائر رغم الأهمية التي منحت له من خلال تنظيمه بترسانة من النصوص القانونية المتسلسلة وصولا الى القانون 23-17 الذي يحدد شروط وكيفيات منح العقار الاقتصادي التابع للأملاك الخاصة للدولة الموجه لإنجاز مشاريع استثمارية. الذي من خلاله أعاد المشرع تنظيم العقار الاقتصادي بتحديد مفهومه وحصر نطاقه وكذا الهيئات المكلفة بتسييره وتهيئته.
