نظام التحكيم بين الزوجين

Résumé: أولى الدين الإسلامي العناية البالغة بعقد الزواج،واعتبره ميثاقا مقدسا،ينعقد بين الزوجين على جهة التأبيد، ولكن قد يحدث ما يعكر صفو الحياة الزوجية من أزمات تهدد كيان الأسرة،وقد تفضي إلى حل الرابطة الزوجية،ولأن الشريعة الإسلامية واقعية في حلولها؛فقد وضعت نظاما وقائيا يحمي الأسرة من التصدع؛ألا وهو نظام "التحكيم بين الزوجين"؛الذي يمتاز بهدفه النبيل المتمثل في الإصلاح،ورد الأمور إلى نصابها؛لاستقرار واستمرار الحياة الزوجية،خاصة وأن مجتمعنا الجزائري يعاني من ارتفاع مقلق في نسب الطلاق،والخلع لأسباب-في الغالب-بسيطة لا تستدعي ذلك. الكلمات المفتاحية:تحكيم؛ حكم؛ إصلاح؛ الزوجين؛ نظام. Abstract: The Islamic Religion gave the extreme care by marriage contract , and considered it sacred covenant ,be between spouses on site of becomes involved in guilt ,But can happen anything to spoil the married life from crisis endanger the structure of the family ,may lead to dissolve marriages ,and that Islamic Shariah havr realistic solutions ,had established its own prevention system protected the family of the striation ;namely “The Arbitration System between Spouses” ;Which has the advantage greater goals could be achieved reform ,and put things right ;for the continued and stability of the married life ,Especially in our Algerian society suffer from horrific rise about divorce rates and Khul ;often for simple reasons mostly don’t call for it.
