الحرية الفردية في ظل أمر المنع من مغادرة التراب الوطني

Résumé: إن للفرد الحق في الحرية الفردية الذي من أسمى حقوقه، واحترام هذا الحق هو أساس بناء المجتمع القائم على العدل، ولقد كفل الدستور الجزائري احترام الحريات الفردية، وأكد على ضمانها والمحافظة عليها وعدم انتهاكها، ويعتبر حق الفرد في التنقل عبر التراب الوطني والدخول إليه والخروج منه بكل حرية من أهم العناصر الأساسية للحرية الفردية، ولقد سعى المشرع الجزائي إلى حماية هذه الحريات من مختلف الانتهاكات وذلك من خلال الموازنة بين المصلحة العامة التي تهدف إلى تحقيق العدالة الجزائية الفعالة للحفاظ على النظام العام، والمصلحة الخاصة التي تهدف إلى حماية حق الفرد في التمتع بحريته الشخصية، سيما حرية التنقل في ظل وجود بعض القواعد الاجرائية التي تقيد التمتع بحرية التنقل ومنها إجراء أمر المنع من مغادرة التراب الوطني الذي استحدثه الأمر 15/02 في المادة 36 مكرر1، وذلك بهدف ضمان عدم إفلات المجرمين من العقاب، وهو في نفس الوقت يعد من أخطر الاجراءات التي قد تمس بحقوق وحرية الفرد المكفولة دستوريا. Abstract: Individual freedom is one of the supreme and noblest rights that establish a cohesive society ruled by justice. The Algerian Constitution, itself, guarantees respect of individual freedoms and ensures their safeguard and non-violation. Therefore, the right of every individual to the entry to and departure freely from the national territory is one of the most fundamental elements of individual freedom. For the Algerian legislator has sought to protect these freedoms from various violations by balancing between the public interest, aiming at achieving effective penal justice in order to preserve public order, and private interest, which aims to protect the right of the individual to enjoy his or her personal freedom,notably the freedom of movement in light of the presence of certain procedural rules restricting his or her enjoyment of such freedom, namely the measureprohibiting the leaving of the national territory, created by Order N 15/02 in article 36 bis 1, in order to ensure that criminals would not go unpunished. Yet, it is, in the same time, one of the dangerous measures that may affect the constitutionally guaranteed rights and freedoms of the individual.
