القواعد الفقهية المتعلقة بالإرث وتطبيقاتها في قانون الأسرة الجزائري

Résumé: يُحيط موضوع هذه الدّراسة بالقواعد، الفقهية المتصلة بالإرث وتطبيقاتها في قانون الأسرة الجزائري، بحيث تنطلق ببيان القواعد الفقهية التي أوردها علماء الشريعة الإسلامية في باب المواريث، ومستندات العمل بها من كتاب، وسنة وإجماع، مع محاولة إسقاطها على مسائل تدخل في أحكام الميراث، من أسباب وشروط وموانع، وصولا إلى البحث في مدى تطبيق المقنن الجزائري لهذه القواعد الفقهية والعمل بها في النّصوص القانونية الخاصة بالمواريث الواردة في قانون الأسرة. . Abstract: The subject of this study surrounds the jurisprudential rules related to inheritance and their applications in the Algerian family law, so that it starts with a statement of the jurisprudential rules mentioned by the scholars of Islamic law in the section of inheritance, and the documents for their work from the book, Sunnah and consensus, with an attempt to drop them on issues that fall within the provisions of inheritance, from the reasons And conditions and barriers, leading to the search in the extent to which the Algerian codified application of these jurisprudential rules and their implementation in the legal texts related to inheritance contained in the family law..
