مدى حجية مصادر الاحكام عند الامام ابن حزم الظاهري (ت456هـ)

Résumé: الحمد لله رب العالمين والصلاة والسلام على سيدنا وشفعينا رسول الله، وعلى آله وصحبه ومن اتبع هداه. فهذا بحث موجز عن حياة الامام ابن حزم (رحمه الله) ومدى حجية مصادر الاحكام عنده حيث وجدت في كتاب المحلى للإمام ابن حزم (رحمه الله) فقهاً غزيراً ومسائل في غاية الوضوح لاسيما عند عرضه لأقوال العلماء مبيناً الأصول التي استند إليها، وكذلك رغبتي في التعرف على حياة هذا الإمام الجليل (رحمه الله) ومنهجه المتميز عن بقية العلماء، وقد قسمت الموضوع على مبحثين وخاتمة. المبحث الاول: حياة الامام ابن حزم وما يتعلق بها عدة مطالب:تكلمت فيها عن اسمه ونسبه وولادته. ثم عن نشأته العلمية, ثم عن مكانته العلمية وأقوال العلماء فيه.و وفاته. وكان المبحث الثاني يتكلم عن مدى حجية مصادر الاحكام عند ابن حزم الظاهري. وفيه مطلبان: الاول في منهج الامام ابن حزم في عرض المسائل. والثاني في منهج الإمام ابن حزم في الاستدلال. أما الخاتمة فقد أوضحت فيها نتائج البحث.وكان ابرزها ماظهر لي هو ان الامام ابن حزم كان يستند بظواهر النصوص الشرعية من الكتاب والسنة، ويستدل باجماع الصحابة (رضي الله عنهم) المستند الى النص ولا يأخذ بإجماع غيرهم. This is a brief research on the life of Imam Ibn Hazm (may Allah have mercy on him) and his method in his local book. Perhaps the main reason for the choice of writing in this topic is that I found in the book of the Mufti of Imam Ibn Hazm (may Allah have mercy on him) Which was based on it, as well as my desire to know the life of this Imam Jalil (may Allah have mercy on him) and his method distinguished from the rest of the scholars, and has divided the subject on two topics and a conclusion. The first topic: the life of Imam Ibn Hazm and related to it and in it five demands: I spoke about his name and descent and birth. And then about his scientific inception, and then spoke about his works. Then about his scientific status and the statements of the scholars in it. And his death. The second topic was about the approach of Imam Ibn Hazm in his local book. There are two demands: the first in the approach of Imam Ibn Hazm in presenting the issues. And the second in the approach of Imam Ibn Hazm in the inference. The most important of these is that Imam Ibn Hazm was based on the phenomena of the shar'i texts of the Qur'aan and Sunnah, and the consensus of the Companions (may Allah be pleased with them) is based on the text and does not take the consensus of others.
