المسائل الملقبة في الميراث في قوانين الأسرة المغاربية
Résumé: يعالج موضوع هذا البحث المسائل الملقبة في الميراث في قوانين الاسرة المغاربية والمقصود بها المسائل الشاذة والمشهورة التي اشتهرت لأسباب كثيرة إما نسبة لقضاء او موطن من قام بقسمتها او لمصادفتها لأصول صحابي من الصحابة الكرام ،والمسائل الشاذة التي خرج الحكم فيها عن الاحكام والقواعد المقررة في الارث، وهو ما اقتضى فتح باب الاجتهاد فيها بإعمال الرأي قصد الوصول الى احكام عادلة ومنصفة. حيث قمنا بتقسيم المسائلبالنظر الى الاحكام التي تحكم هذه المسائل ومدى موافقتها للقواعد العامة في الميراث الى فصلين فصل اول خصصناه لتناول المسائل الشاذة والفصل الثاني تعرضنا فيه للمسائل المشهورة وعرضنا اقوال الصحابة وآرائهم والفقهاء من بعدهم في قسمة هاته المسائل واستعرضنا موقف القوانين الاسرة العربية وما سارت عليه قوانين الاحوال الشخصية في قسمة هاته المسائل. الكلمات المفتاحية: التشريعات العربية-الميراث-المسائل الخاصة-الفقه الإسلامي Summary of research The subject of thisstudy deals with one of its important parts, namely: the "Special Issues of Inheritance", thatmeansknown and famous issues thatwerecommon and famous for manyreasons: either to asksomeone and hisanswerwas right or wrong, to approve the saying of one of the valuedProphetCompanions, a judgment of someonewhodividedit, or otherwise. As well as anomalous issues thatrule out all the provisions and rulesestablished in the inheritance, because the division undertheserulesisconnected to forsakepurposesuponwhich the science of inheritancewasestablished, whichisrequired to open the door of Ijtihad(independentreasoning) in the realization of opinion intended to reach a fair and equitableterms. This subject Issues have been dividedaccording to control rules of these issues, and how muchthey are compliedwith the generalrules of inheritance, thisstudyconsists of twochapters, the first one wasallocated to address the abnormal issues and violation of general. concepts in inheritance, and the second one wasexposed to the well-known issues. The studyalsofocused on two aspects: the jurisprudentialside (Fiqhi), by rootingthese issues jurisprudentially, introducedstatements and opinions of ProphèteComparions and scholarsafterthem in dividingtheseissues, show in agreement and variation positions, and the singularity of some opinion sometimes, and the legal and legislativeside, and by comparing the opinions and views of jurisprudence withwhatchosen in personalstatuslaws in Arab countries. keywords :
