الحماية القانونية للأطفال ذوي الاحتياجات الخاصة في الجزائر

Résumé: نصت الاعلانات والمواثيق الدولية الصادرة عن الأمم المتحدة، المتمثلة في الاعلان العالمي لحقوق الإنسان والعهدين الدوليين على أن للطفولة الحق في رعاية ومساعدة خاصتين ينص عليها تشريع الدولة وتضمنها الدولة والمجتمع والأسرة، وفي ظل ذلك جاءت اتفاقية حقوق الطفل لتبين مضمون الرعاية والمساعدة الخاصة التي يحظى بها الطفل، كما نصت في المادة 23 منها على حقوق الطفل المعاق عقليا أو جسديا، وألزمت الدول بالاعتراف بحقوق الطفل المعاق وحمايتها. وتماشيا مع الاتفاقيات والإعلانات الدولية تضمن الدستور الجزائري في المادة 72 منه على حماية الاسرة والمجتمع والدولة لحقوق الطفل، كما نصت على قمع القانون العنف ضد الاطفال، وبالرجوع للقانون 15-12 المتعلق بحماية الطفل، نجد أنه وفر الحماية الاجتماعية والقضائية للطفل ولاسيما الطفل في خطر، وقسم الحماية الاجتماعية إلى الحماية على المستوى الوطني تقدمها الهيئة الوطنية لحماية وترقية الطفولة وخصوصا دور المفوض الوطني لحماية الطفولة، والحماية على المستوى المحلي وتتولاها مصالح الوسط المفتوح بالتنسيق مع الهيئات والمؤسسات العمومية المعنية بالطفل. The international declarations and covenants issued by the United Nations, which are represented in the Universal Declaration of Human Rights and the two International Covenants, stipulated that childhood has the right to special care and assistance stipulated in the state’s legislation and guaranteed by the state, society and family, and in light of that the Convention on the Rights of the Child came to clarify the content of special care and assistance enjoyed by the child And, in Article 23 of it, it stipulated the rights of the mentally or physically handicapped child, and obligated states to recognize and protect the rights of children with disabilities. In line with international agreements and declarations, the Algerian constitution included in article 72 of it the protection of the family, society and state of the rights of the child, as well as stipulating the suppression of the law against violence against children, and by referring to Law 12-15 related to child protection, we find that it provided social and judicial protection for the child, especially the child in danger, The Department of Social Protection to Protection at the national level Is provided by the National Authority for the Protection and Promotion of Childhood, especially the role of the National Commissioner for Childhood Protection, and protection at the local level and by the interests of the open community in coordination with public bodies and institutions concerned with children.
