الطعن في قرارات مجلس المنافسة كأداة لحماية الاقتصاد الوطني

Résumé: تعد قرارات هيئة مجلس المنافسة، قرارات غير مرضية لكل المتعاملين الاقتصاديين، مما يستدعي تمكينهم من الطعن فيها أمام القضاء، والذي يعتبر الضامن لمبادئ المنافسة، وفي هذا المقال ارتأينا البحث في الطبيعة القانونية لمجلس المنافسة حتى نتمكن من تحديد طبيعة قراراته، خاصة وأنه يتبادر للوهلة الأولى أن هذا المجلس ذو طبيعة إدارية بامتياز. لهذا نظم المشرع الجزائري مسألة الطعن في قرارات مجلس المنافسة عبر طرق واجراءات ووسائل. ذات طابع ردعي وطابع إداري لقراراته، ولن يتأتى هذا الا عن طريق اتباع طرق الطعن القضائي في قرارات مجلس المنافسة، سواء عن طريق الطعن القضائي في قراراته أمام القضاء العادي وأمام القضاء الإداري، لحماية الاقتصاد الوطني. The decisions of the Competition Council Authority are considered unsatisfactory decisions for all economic dealers, which calls for their empowerment to appeal them before the judiciary, quarantining competition principles. In this article, we decided to research the legal nature of the competition board/council in order to determine the nature of its decisions, especially since it appears at first glance that this Council is of an administrative nature par excellence. That is why the Algerian legislator has organized the issue of contesting the Competition Council decisions through methods, procedures and means of a deterrent and an administrative nature of its decisions. This will not be possible except by following the methods of judicial appeal against the decisions of the Competition Council, whether through judicial appeals against its decisions before the ordinary judiciary and before the administrative judiciary.
