"قواعد الحدود عند أبي حامد الغزالي من خلال كتابه "المستصفى

Résumé: الملخص: يروم هذا البحث الكشف عن قواعد تعريف المصطلح الأصولي عند الغزالي، انطلاقا من مقدمة كتابه "المستصفى في أصول الفقه". هذه القواعد التي يمكن اعتبارها صالحة لتعريف المصطلحات في سائر العلوم وليس في علم أصول الفقه وحده، لكونها قوانين عامة مبنية على علم المنطق، ولأنها كذلك تتميز بمرونة تجعلها تتلاءم وخصائص تعريف المصطلحات الشرعية على الخصوص، وهو ما سيتبين حين عرض قوانين الحد وخصائصها ومميزاتها عند الغزالي. وينطوي هذا البحث على جانب عملي، انصب على دراسة أمثلة من الحدود والتعاريف المستقاة من الكتاب نفسه، والقصد من ذلك تقييم مدى استجابتها لقوانين الحد المذكورة، ودرجة الدقة في صياغتها. وتتناول تلك الأمثلة، التي أفردت بالدراسة، مصطلحات مختلفة، منها الفقهي ومنها الأصولي ومنها غير ذلك . الكلمات المفاتيح: المصطلح; القاعدة; التعريف; الحد; أصول الفقه; علم المنطق. Abstract : This research Is concerned with the term; its importance and its definition rules of its definition at Al-Ghazali, starting from the introduction of his book "almustassfa fi ossol lfiq’h". These rules, which can be considered valid to define the terminology from all kind of sciences, not only in the principales of Islamic jurisprudence, as they are general rules based on the logic, with the enough flexibility that makes them fit the legitimate terminology definition characteristics at particular, which will be clarified during the view of the limits laws and their characteristics and advantages at Al-Ghazali. This research has a practical aspect interested in studying examples of the limits and the definitions derived from the book itself, in the purpose of evaluating their response to the limit laws and the degree of precision in their formulation as a limit to a particular term. The examples deal with different terminology, including jurisprudence, fundamentalism and others. Key words: term, rule, definition, principles of jurisprudence, logic.
