تشديد الوصاية الإدارية على الجماعات المحلية في الجزائر

Résumé: لقد أضحى من المؤكد أن إدارة وتسير الجماعات المحلية لشؤونها المحلية بشكل جيد، يتطلب أن تتمتع باستقلالية حقيقية، إلا أن ذلك لا يمكن أن يتحقق إلا من خلال رقابة بمختلف أشكالها تمارسها السلطة المركزية لتكريس سيادة القانون، ولضمان نوع من الانسجام بينها وبين الجماعات المحلية. وبالرجوع إلى قانوني البلدية 11/10 والولاية 12/07 نجد أن المشرع الجزائري أخضع الجماعات المحلية لوصاية إدارية مشددة سواء على المجلس كهيئة، أو على الأعضاء أو على الأعمال، مما فسح المجال للسلطة المركزية لبسط هيمنتها على الأجهزة المحلية المنتخبة، ومشاركتها في اتخاذ قرارتها. The good management of local communities for their local affairs requires that they have real independence. However, this can only be reached through the control exercised by the central authority in various forms in order to strengthen the rule of law, and to ensure cohesion between it and the local authorities. Regarding the municipal law 11/10 and the wilaya law 12/07, we can see that the Algerian legislator subjects local communities to strict administrative control, whether over the council as a body, over its members or over its affairs, which has enabled the central authority to extend its domination over elected local bodies and their participation in decision-making.
