الإدارة الإلكترونية في مجال الصفقات العمومية دراسة مقارنة بين التجربتين الجزائرية و المغربية

Résumé: إذا كان وجود النص القانوني هو اللبنة الأولى لتجسيد مشروع المرفق العمومي الإلكتروني، في هذا الشأن فقد تدخل كل من المشرع المغربي و المشرع الجزائري لإرساء النظام القانوني للمرفق الإلكتروني في مجال الصفقات العمومية، و رغم فتو تجربة الإدارة الإلكترونية في الجزائر و المغرب، إلا أنها تتخبط في عدة معوقات، منها ما ترتبط مباشرة بطبيعة التكنولوجية الرقمية (الأخطار الأمنية)، و منها ما يرتبط بالبيئة المغاربية من حيث إمكانياتها المادية و البشرية، تهدف هذه الدراسة إلى تقييم التجربة الجزائرية للإدارة الإلكترونية في مجال الصفقات العمومية، و هذا مع المقارنة مع نظيرتها المغربية. وقد خلصت هذه الدراسة إلى أن تجربة البوابة الإلكترونية للصفقات العمومية، فضلا عن كونها جاءت متأخرة مقارنة بنظيرتها المغربية، فإنها لا تزال تتخبط في جملة من العراقيل، كما أنها في حاجة إلى المزيد من الاهتمام من جانب المشرع لضمان سهولة الولوج إليها و سلامة التعامل بها. Abstract:(Do not exceed 150 words) If the presence of the legal text is the first block to embody the electronic public utility project, in this regard, both the Moroccan and the Algerian legislators have stepped in to establish the legal system for the electronic public utility in the field of public procurement Despite the novelty of the experience of electronic management in Algeria and Morocco, it is floundering in several obstacles, these obstacles are not directly related to the nature of digital technology (security dangers) and some of them are related to the Maghreb environment, in terms of its material and human capabilities. This study aims to evaluate the Algerian experience of electronic management in the field of public deals, and this is in comparison with its Moroccan counterpart. This study concluded that the experience of the electronic portal for public deals, as well as being late compared to its Moroccan counterpart, is still floundering in a number of obstacles, and it needs more attention on the part of the legislator to ensure easy access to it and the safety of dealing with it.
