الذكاء الإصطناعي بين مطرقة القانون وسندان الإبتكار التكنولوجي

Résumé: مع ظهور الثورة الصناعية الرابعة ، شهد نظام الذكاء الإصطناعي تطورا متسارعا ، أدى إلى تغييرات متزايدة على حياة الإنسان في ظل العالم الرقمي ، لما له من قدرة على ضرب توازنات في بيئة المجتمع مما يؤثر على سلوكيات الأفراد والمجتمع بأسره، مما طرح تحديات قانونية جديدة تتعلق بالخصوصية والآمان والمسؤولية القانونية ، جعلت الدول في رهان لتطوير المنظومة التشريعية ، ما يضمن التوازن بين تشجيع التطور التكنولوجي ومواجهة المخاطر الناجمة عنه، بوضع قواعد قانونية تنظم إستخدام الذكاء الإصطناعي والإستفادة من إيجابياته والحد من سلبياته. Abstract: With the emergence of the Fourth Industrial Revolution, the artificial intelligence system has witnessed rapid development, leading to increasing changes in human life in the digital world, due to its ability to disrupt balances in the societal environment affecting the behaviours of individuals and the community as a whole, posing new legal challenges related to privacy, security, and legal responsibility, making countries confront the development of the legislative system to ensure a balance between encouraging technological advancement and facing the risks arising from it, by establishing legal rules regulating the use of artificial intelligence and benefiting from its positives and mitigating its negatives.
