الحصار على غزة أحد أشكال الفصل العنصري

Résumé: بدأ بناء الجدار في 2002 في ظل انتفاضة الأقصى، وتقدم إسرائيل التبرير بالضرورة الأمنية أو بحق الدفاع عن النفس. الجدار يتعدى على حقوق الفلسطينيين المقيمين في المناطق المحتلة من قبل إسرائيل. وهي ممارسات منهجية في سياسة الفصل العنصري الذي يعتبر جريمة من الجرائم ضد الإنسانية. الحصار الثلاثي المركب عن غزة وهو بناء الجدار العازل وإغلاق المعابر ووقف قوافل الإغاثة سواء مصرية أم دولية عن طريق الجدار الفولاذي المصري. رغم أن جريمة التمييز العنصري تعتبر من الجرائم الجسيمة ضد الإنسانية إلا أن نظام روما الخاص بالمحكمة الجنائية الدولية لم يعالج إلا جزءا واحدا منها، وأورده من الجرائم الدولية، وهو الخاص بالفصل العنصري Apartheid كما كانت تمارسه جنوب إفريقيا. ومع تصاعد العنف في الأراضي المحتلة يبدو واضحا أن كل جريمة من الجرائم ارتكبها الكيان الإسرائيلي في حق الفلسطينيين، حيث ما تقوم به قوات الاحتلال الإسرائيلي في الأراضي الفلسطينية المحتلة هو انتهاك سافر لمعايير ومبادئ القانون الدولي الإنساني ويشكل مخالفة جسيمة لاتفاقية جنيف الرابعة الخاصة بحماية المدنيين وقت الحرب لسنة 1949 . وهو يشكل بالأساس نوعا من أنواع التمييز العنصري الذي تتم ممارسته من خلال عمليات الفصل العنصري. On April 2002, Israel decided to build the “the wall in the West Bank under the pretext of cracking down the Palestinian resistance and stopping the Palestinian’s operations. Israel swallowed up half of the West Bank’s lands, took over the resources of the Palestinians, and carried out plans to expel and displace the Palestinian people. Two similar barriers, the Israeli Gaza strip barrier and wall separating Gaza to Egypt which is currently under Egyptian control. It became clear from the context of our previous presentation that the so-called “Apartheid wall”, is not just a wall or fence, its purpose is not confined to separation or security. The Apartheid wall is a crime against humanity. The term « crimes against humanity » is recognized by ICC statute as including acts such as murder, extermination, enslavement, deportation, torture, rape, when committed as part of a widespread or systematic attack directed against any civilian population before or during the war. The International Court of justice (ICJ) ruled illegal Israel’s massive separation that alongside and inside the Palestinian territories. But The ICJ in its advisory opinion on the barrier, wrote it had chosen to use the term “wall” as “the other expressions such as Apartheid, fence, separation barrier.
