قواعد تفسير المعاهدات الدولية

Résumé: تعد مسألة تفسير المعاهدات الدولية من المسائل الهامة في القانون الدولي العام، كونها السبيل إلى إجلاء وتوضيح ما قد ينتاب هذه المعاهدات من غموض لدى الأطراف المتعاقدة، خصوصا أثناء عملية تنفيذ الدول لالتزاماتها تجاه هذه المعاهدات، وقد يكون ذلك كنتيجة –مثلا-لقصور في فهم بعض النصوص أو العبارات الواردة فيها، مما قد يؤدي إلى التأويل الذي من شأنه إخراج النص عن المعنى المقصود منه. وعليه فسيتم التركيز في هذه الدراسة على إبراز القواعد المعتمدة في تفسير المعاهدات الدولية حيال هذه الوضعية، وذلك من خلال تبيين الجهات المختصة بعملية التفسير، وكذا الطرق المتبعة في عملية التفسير هاته. The Interpretation of International Treaties is considered one of the most important issues in Public International Law because it is the way to clarify the ambiguities of treaties of contracting parties, especially in the implementation by states of their obligation to these treaties. States may be subject to indequate understanding of treaties, which requires resort to their interpretation. The focus in this study will be on highlighting the rules adopted in the interpretation of International Treaties, this is through the clarification of competent authoroties and so are the methods used in this.
