إشكاليات تطبيق قاعدة اختصاص القانون المحلي في مجال المسؤولية البيئية

Résumé: تعد قاعدة اختصاص القانون المحلي ،أي قانون المكان الذي وقع فيه الفعل المنشئ للالتزام من أقدم القواعد التي تطبق على المسؤولية المدنية بصفة عامة والمسؤولية البيئية على وجه الخصوص ،وقد لاقت قبولا ورواجا لدى فقهاء القانون الدولي الخاص لزمن بعيد ، ولكن التطورات التي شهدتها الساحة الدولية وازدهار الصناعة والتجارة ..... الخ أثارت عدة إشكاليات تطبيقية لهذه القاعدة في حال توزع عناصر المسؤولية بين دولتين مختلفتين أو بين عدة دول . فظهرت عدة نظريات فقهية لتحديد مفهوم القانون المحلي ، هل هو قانون الدولة التي وقع فيها الخطأ ، أم قانون الدولة التي تحقق فيها الضرر ، وذلك في حال توزع عناصر المسؤولية بين دولتين فقط ، أما إذا توزعت عناصر المسؤولية بين عدة دول فإن الفقه المِؤيد للقانون المحلي طرح عدة حلول في حال تعدد دول موقع النشاط أو تعدد دول تحقق الضرر. Abstract:The rule of local law jurisdiction, That is, the law of the place in which the act creating the obligation took place is one of the oldest rules that apply to civil liability rules in general and environmental liability in particular, and it has been accepted and popular among jurists of private international law for a long time ،However the developments in the international arena, the flourishing of industry and trade, etc., raised several problems in the application of this rule in the event that the elements of responsibility are distributed between two different countries or between several countries. Several jurisprudential theories emerged to determine the concept of local law, is it the law of the country in which the error occurred, or the law of the country in which the damage was achieved, in the event that the elements of responsibility are distributed between two countries, but if the elements of responsibility are distributed among several countries, then jurisprudence The supporter of local law put forward several solutions in the event of multiple countries where the activity is located or multiple countries achieve harm
