مدى فعالية التظلم الإداري كإجراء للتسوية الودية للمنازعة الإدارية في قانون الإجراءات المدنية و الإدارية والقوانين الخاصة

Résumé: ييمنح التظلم الإداري للإدارة فرصة لإصلاح أخطائها وإعادة النظر في موقفها، وبالنتيجة يخفف العبء على القضاء الإداري بإنهاء المنازعة الإدارية في بدايتها بشكل لا يؤدي إلى تطور الأمر إلى منازعة قضائية تٌطرح أمام القضاء. وفي ذلك توفير للجهد والمال لذوي الشأن من ناحية، وتخفيف العبء الواقع على كاهل القضاء من ناحية أخرى. إلا أنه رغم الإصلاحات القانونية الواردة في هذا الإجراء فإن الواقع العملي أثبت عدم نجاعته كإجراء للتسوية الودية وحسم الخلافات بشكل جدي، فما زال التظلم الإداري اتجاه الإدارة بعد إجراءً وقائيا غير مُحفّز للفرد وامتياز في يد الادارة..Administrative grievance gives the administration an opportunity to correct its mistakes and reconsider its position, as a result, the burden on the administrative judiciary is reduced by ending the administrative dispute at the beginning, in a manner that does not lead to the evolution of the matter into a judicial dispute before the courts, this will save the effort and money of the concerned parties on the one hand and reduce the burden on the judiciary on the other hand. However, the practical situation has proved ineffective as a measure of friendly settlement and serious resolution of differences. The administrative grievance is still the direction of the administration after a preventive measure that does not stimulate the individual and privilege in the hands of the administration.
