" المراقبـة الإلكترونيـة في التشريـع الجزائري "

Résumé: يعد إجراء الوضع تحت المراقبة الإلكترونية من الموضوعات المستحدثة في مجال العدالة الجنائية المعاصرة، ويتمثل في توظيف التكنولوجيا الحديثة في مجال إعادة إدماج المحكوم عليهم في المجتمع مرة أخرى من خلال منحهم الفرصة في الانخراط في المجتمع وذلك تحت رقابة أجهزة العدالة الجنائية، وهو الأمر الذي دفع معظم الأنظمة العقابية المعاصرة إلى تبني الوضع تحت المراقبة الإلكترونية ويعد من أحد أهم وأبرز تطبيقات التطور العلمي في المجال العقابي الذي أظهر ضرورة إيجاد بدائل لهذه العقوبات بغير الأساليب العقابية التقليدية. ويقوم الوضع تحت المراقبة الإلكترونية على تنفيذ العقوبة بطريقة مبتكرة خارج أسوار السجن – في الوسط الحر- بصورة ما يسمى "السجن في البيت" ويتضمن هذا الأسلوب نظاماً الكترونياً للمراقبة عن بعد، بموجبه يمكن التأكد من وجود أو غياب الشخص عن المكان المخصص لإقامته بموجب حكم قضائي، حيث يسمح للمحكوم عليه بالبقاء في منزله، لكن تحركاته محدودة ومراقبة بمساعدة جهاز مثبت في أسفل قدمه (السوار الإلكتروني). موضوع هذه الدراسة يهدف إلى تسليط الضوء على الوضع تحت المراقبة الإلكترونية في التشريع الجزائري من خلال تحليل شروط تطبيقه وكيفية الاستفادة منه. Abstract: Electronic supervision is one of the themes developed in the field of modern criminal justice, namely the recruitment of modern technologies in the field of the reintegration of convicts in society by giving them the opportunity to get involved in society. under the control of criminal justice agencies, This has led most contemporary criminal systems to adopt electronic surveillance placement and is one of the most applications of punitive scientific development, which has demonstrated the need to find alternatives to these penalties, were August to traditional punitive methods. Electronic surveillance placement is based on innovative enforcement of sanctions outside the prison walls - in the free environment - in a way that is called "home jail". this includes an electronic remote control system to determine the presence or absence of a person from the place of residence under the Judiciary provision, where the detainee is allowed to stay at home, for limited movements and monitoring using a device installed at the bottom of his foot (electronic bracelet). The objective of this study is to shed light on the location under electronic surveillance in the Algerian legislation by an analysis of the conditions of its application and its mechanism of its implementation.
