آليات الرقابة الداخلية على الصفقات العمومية في ظل المرسوم الرئاسي 247/15

Résumé: لم يترك المشرع الجزائري إبرام الصفقات العمومية دون قيود، بل فرض عليها رقابة سابقة على ابرامها وهي رقابة قبلية أو ما يعرف بالرقابة الداخلية، وذلك عن طريق لجان تعرف ب"لجنة فتح الأظرفة وتقييم العروض"، وهي لجنة تتكفل بالدور الإداري والرقابي وذلك بفحص وتحليل ومراقبة تنفيذ العروض وهو ما نص عليه المرسوم الرئاسي 15/247 الذي عدد صلاحيات ومهام اللجنة. لذلك تعتبر هذه الرقابة أداة فعالة في الحد من التجاوزات التي تمس الصفقات العمومية بصفة عامة والمتعاملين الاقتصادين بصفة خاصة. وذلك بإضفاء مبدأ النزاهة والشفافية التي كرستها قوانين الصفقات العمومية بين المتعاملين الاقتصاديين. The Algerian legislator did not leave the conclusion of public deals without restrictions, but imposed on them prior control over their conclusion, which is the internal tribal oversight, through committees known as the" open envelopes and evaluation of offers " committittees, which is a committee that undertakes the asministrative and supervisory role by examining, analyzing, and monitoring the implementation of offers,which is stated it has Presidential Deceree 15/247that sets out the powers and functions of the committee. Therfore, this controlis considered an effective tool in curbing the violations that affect public deals in general and economic dealers in particular, by adding the principle of integrity and transparency enshrined in procurement legislation among economic dealers
