رقابة قاضي المشروعية على قرارات المجلس النقدي و المصرفي

Résumé: .الملخص: باعتباره من السلطات الإدارية في الدولة منح المشرع الجزائري المجلس النقدي و المصرفي امتياز إصدار القرارات التنظيمية والفردية لضبط النشاط المصرفي. إلا أن هذه السلطة التي يتمتع بها المجلس لا تحول دون خضوعه لرقابة قاضي المشروعية، لحماية المتعاملين الاقتصاديين المتدخلين في القطاع من أي تعسف وكذا ضمان مشروعية تلك القرارات الإدارية الصادرة عنه. و لقد عهد المشرع باختصاص تلك الرقابة القضائية للمحكمة الإدارية للاستئناف بالجزائر العاصمة بدل مجلس الدولة سابقا، وأسبغ خصوصية على دعوى المشروعية التي ترفع أمامها ضد قرارات المجلس وكيف إجراءاتها بطابع استثنائي . Abstract: As one of the administrative authorities of the State, the Algerian legislator granted the Monetary and Banking Council the privilege of making regulatory and individual decisions to control banking activity. However, this authority enjoyed by the Council does not prevent it from submitting to the control of the judge of legality, from protecting economic operators involved in the sector from any arbitrariness, as well as from guaranteeing the legitimacy of the administrative decisions it issues. . The legislator entrusted the competence of this judicial review to the Administrative Court of Appeal of Algiers in place of the Council of State previously, and made confidential the legality trial brought before it against the decisions of the Council and the character exceptional in its procedures.
