الولاية الأصلية للأم على أموال أبنائها القصر

Résumé: يعجز الأبناء القصر عن رعاية مصالحهم المالية بسبب صغر سنهم وعدم اكتمال أهلية الأداء لديهم، لذا أخضعهم القانون لنظام الولاية الأصلية على المال، وأوكل مهمة المحافظة على أموالهم لوليهم الشرعي و هو الأب بالدرجة الأولى، ومن بعده الأم ثم الجد طبقا للمادة 87 و 92 من قانون الاسرة الجزائري. تتناول هذه الورقة البحثية دراسة مفهوم و أحكام الولاية الأصلية للأم على مال أبنائها القصر التي نظمها المشرع الجزائري في المواد 87 الى 91 من قانون الأسرة الجزائري، و مقارنتها بالأحكام الموجودة في قوانين بعض الدول العربية، من أجل الوقوف عند مواطن النقص أو الخلل الموجودة في القانون الجزائري، اين توصلنا الى جملة من النقائص تم مناقشتها في هذه الدراسة. Abstract: Minor children are unable to take care of their financial interests law, due to their young age and incomplete eligibility for performance, so the law subjected them to the original guardianship system over money, and entrusted the task of preserving their money to their legal guardian, who is the father in the first place, and then the mother and then the grandfather in accordance with Articles 87 and 92 of the Algerian Family Code. This research paper deals with the study of the concept and provisions of the original guardianship of the mother over the property of her minor children organized by the Algerian legislator in Articles 87 to 91 of the Algerian Family Code, and comparing them with the provisions contained in the laws of some Arab countries, in order to stand at the shortcomings or defects in Algerian where we reached a number of shortcomings were discussed in this study.
