التراضي إجراء إستثنائي في إبرام الصفقات العمومية في القانون الجزائري

Résumé: يتميز أسلوب التراضي في الصفقات العمومية عن أسلوب طلب العروض بمرونة إجراءاته بحيث يمنح للمصلحة المتعاقدة السلطة التقديرية في تخصيص صفقة لمتعامل متعاقد واحد فقط بعد الاتفاق المباشر عن طريق المفاوضات،مع مراعاة جملة من الضوابط التي تساهم في المحافظة على المال العام،وكما رخص المشرع للمصلحة المتعاقدة ان تلجأ إلى هذا الإجراء في إبرام الصفقات في إطار الوقاية من انتشار وباء فيروس كورونا كوفيد-19 ومكافحته.The consensual method in public deals is distinguished from the request for proposals method by the flexibility of its procedures,where by it gives the contracting administration the discretionary authority to allocate a deal to a single contracting dealer after direct agreement, through negotiations, ,and it also appears that the legislator permits for the contracting authority to resort to this procedure in concluding deals in the framework of preventing and combating the spread of the novel coronavirus (covid 19) epidemic
