تملك العقارات بالتقادم المكسب على خلاف الثابت بالسجل العيني في التشريع الجزائري

Résumé: ملخص: يعتبر التقادم المكسب من أهم أسباب الملكية العقارية والحقوق العينية الأخرى والتي نص عليها المشرع الجزائري وأغلب التشريعات المقارنة، إلا ان هذه التشريعات قد تباينت بخصوص إعمال هذا السبب المكسب للملكية على العقارات المشهرة، سيما في تلك الدول التي تتضمن نظام الشهر العيني، هذا الأخير الذي من بين مبادئه حظر التملك بالتقادم وتحقيق مبدأ القوة الثبوتية للشهر. فالمشرع الجزائري أخذ بنظام التقادم المكسب للعقارات في القانون المدني، سيما بموجب المواد 827، 828، 829، وفي المقابل تبنى نظام تورنس لشهر التصرفات العقارية وذلك بموجب الامر 75/74 المتضمن مسح الأراضي العام وإعداد السجل العقاري، وهنا وقع في إشكالية صعوبة اندماج هذه الإجراءين المتعارضين من حيث التطبيق. وذلك من خلال هذا المقال الموجز سأحاول الوقوف على مدى أخذ المشرع بنظام التقادم المكسب تماشيا مع أخذه بنظام الشهر العيني لشهر الحقوق والتصرفات المنصبة على عقارات أو حقيق عينية. الكلمات المفتاحية: شهر عيني، تقادم مكسب، حيازة، قوة ثبوتية. Abstract: the prescription is considered one of the most important reasons for real estate ownership and other real rights, which were stipulated by the Algerian legislator and most of the comparative legislation.
