Résumé: يدرسُ هذا البحثُ فصلين من قانون الأحوال الشخصية التونسي؛ الفصل (9) المتعلق بمسألة الولاية، والفصل (18) المتعلق بمسألة تعدد الزوجات، ويهدفُ إلى بيان مدى مخالفة أحكام هذين الفصلين للفقه الإسلاميّ، كما يهدفُ إلى بيان أهمية اعتماد الشريعة الإسلامية كمرجع أساسي للقانون، ومن أهم نتائج البحث أن المشرّع التونسي له عدة مخالفات شرعية في أحكام الأسرة، ومن ذلك إلغاؤه لمعنى الولاية في الفصل (9)، وتجريمه لتعدد الزوجات على الإطلاق دون قيد ولا استثناء في الفصل (18). This research studies two articles of the Tunisian Personal Status Law; article (9) on the issue of guardianship, and article (18) on the issue of polygamy. It aims to explain the extent to which the provisions of these two articles contravene Islamic jurisprudence. It also aims to explain the importance of adopting Islamic Sharia as a basic reference for the law. One of the most important results of the research is that the Tunisian legislator has several Sharia violations in family rulings, such as abrogation of the meaning of guardianship in article (9), and his criminalization of polygamy at all without restriction or exception in article 18
