نظام ضمان الودائع المصرفية في الجزائر في ظل القانون النقدي والمصرفي - دراسة مقارنة -

Résumé: تهدف هذه الدراسة إلى تسليط الضوء على أهم ما جاء به القانون رقم 23-09 المؤرخ في 21 جوان 2023 المتضمن القانون النقدي والمصرفي. حيث تم الاعتماد على المنهج الوصفي التحليلي قصد تناول أهم مستجدات القانون التي شملت القطاع المصرفي الجزائري، مع التركيز على الأحكام الجديدة المتعلقة بنظام ضمان الودائع المصرفية. وتوصلنا في الأخير إلى أن نص القانون الجديد تضمن توسيع مفهوم البنوك المعتمدة المشاركة في تمويل صندوق ضمان الودائع المصرفية، والتأسيس القانوني للعمليات المصرفية المتعلقة بالصيرفة الإسلامية. This study aims to highlight the key aspects of Law No. 23-09, dated June 21, 2023, which includes the Monetary and Banking Law. A descriptive and analytical approach was adopted to address the most significant developments in the law, which included the Algerian banking sector, with a focus on the new provisions related to the Deposit Guarantee System. Ultimately, we found that the text of the new law expanded the concept of licensed banks participating in the funding of the Deposit Guarantee Fund and established the legal framework for banking operations related to Islamic banking".
