Résumé: ملخص البحث دليل العُرف، وأثره في بيان حقيقة زواج القاصرات دراسة أصولية – معاصرة يهدف هذا البحث، إلى إيضاح دليل العُرف وأثره، في تبيان حقيقة زواج القاصرات، دراسة أصولية معاصرة. نبين في هذه الدراسة، مفهوم العُرف، عند علماء اللغة العربية، وكذلك مفهومه عند علماء أصول الفقه، وآراء العلماء في حجية دليل العُرف، و الأدلة التي تبرهن على حجيته، ثم تحرير محل النزاع، ثم بيان مفهوم زواج القاصرات، وكيف أثار أعداء الإسلام الشبهات حول زواج القاصرات، وتفنيد ودحض تلك الشبهات، وإثبات صلاحية أدلة الشريعة، والتي من ضمنها دليل العُرف، لكل زمان ومكان، وأهم النتائج التي توصلنا إليها، في هذا البحث. Summary Custom proof, and its impact on the marriage of underage girls Fundamentalist study - Contemporary We show in this study, the concept of custom, from the viewpoint of Arab linguists, as well as scholars of jurisprudence, and scientists' opinions in custom proof, and evidence that demonstrates its authority, then edit the dispute, then the statement of the marriage of underage girls concept, and the suspicions raised by the enemies of Islam, about the marriage of minors, and to refute those suspicions, and evidence to prove the validity of the Islamic law , that includes the custom, for every time and place.
