سدّ الذرائع وأثره الفقهي في احكام الأسرة
Résumé: "تناول هذا البحث موضوع سدّ الذرائع وأثره الفقهي في أحكام الأسرة، وقد حاولت من خلال هذا البحث التطرق إلى دراسة أربعة مسائل معاصرة، مسألتين في الزواج وهما: مسألة زواج المسيار، والزواج بنية الطلاق، ومسألتين في الطلاق هما: مسألة الطلاق الصوري، والخلع القضائي، وتطرقت في دراسة كل مسألة إلى بيان مفهومها، وحكمها، وعلاقتها بسدّ الذرائع. وبعد البحث خرجت بجملة من النتائج أهمها: - أنَّ أصل سدّ الذرائع يعتبر من أجلِّ الأصول في باب الاجتهاد، وآلية وقائية لحماية الشرع عبر الزمن، فهو يحقق مقاصد الشريعة ويحميها. - أنَّ الشريعة الإسلامية جاءت بتحريم ما كانت مفسدتُه أعظم من مصلحتِه سدًّا للذريعة، وقد ثبت بعد البحث أن هذه المسائل تنطوي تحتها العديد من المفاسد والمحاذير. " "This subject is talking abut the living rules in the family life and its legeslations and i was dealing through this research with 4important and new subjects the 2are: marrriage for the sake of devorse and the derived marriage, the 2 other points are: formal devorce, anddislocation judgment, l go in my studies to different parts and coins to explin its relations and after many researches I get this important results: The origin of this issue is considred in the side of diligence and syrugle the legislation through time, it fullfil its ideas and save it. our religion islam is coming with forbiddens all that be corrupted for our benefits, that we discovered among our research. "
