الإطار القانوني للترخيص الإجباري باستغلال براءة الاختراع

Résumé: يعتبر الترخيص الإجباري باستغلال براءة الاختراع رغما عن إرادة صاحبها استثناء أقرّه المشرع الجزائري على حق المالك في استغلال واحتكار براءة اختراعه، وذلك تحقيقا للمصلحة الاقتصادية، والمحافظة على المصلحة العامة، ومواجهة تعسف صاحب البراءة في استعمال حقه بالاستغلال. ولقد نظم المشرع الجزائري أحكام الترخيص الإجباري باستغلال براءة الاختراع في الأمر رقم 03/07 المتعلق ببراءات الاختراع، فبيّن شروط وإجراءات منحه، وهو ما سنحاول بحثه في هذه الدراسة. The compulsory patent licencing overrules a patent-holders right of exclusively using and enforcing a patent. This exception, approved by the Algerian legislation, is granted to safeguard the economic and public interests and to prevent potential abuse by patent owners. If patent owners/holders do not provide a fair, reasonable and non-discriminatory (i.e. FRAND) license, or/and is non-practicing entity (i.e. NPE : a patent holder that does not practice the patent invention), yet prevent other entities from using the patent invention. The Algerian legislator have organized the compulsory licensing in the decree number 03-07 which is related to patent, and the conditions and procedures to grant it. This syudy will cover in details the various facets and implication of this decree.
