الترخيص الاجباري باستغلال براءة الاختراع Compulsory License To Exploit The Patent

Résumé: رغم الحق المقرر لصاحب براءة الإختراع بإستغلال الاختراع على وجه الإستئثار ،ومنع الغير من إستغلال الإختراع بدون موافقته ،فقد أجاز المشرع الحصول على ترخيص إجباري بإستغلال البراءة ،رغما عن صاحبها و ذلك إذا توفرت حالات معينة تتعلق بعدم الإستغلال للإختراع ،أو النقص في هذا الإستغلال من طرف مالك البراءة ،أو الإختراعات المرتبطة ،وأيضا حالة الترخيص الإجباري للمنفعة العامة ،ولكن توفر الحالات السابقة غير كاف لمنح الترخيص الإجباري ،لذلك فلابد من توفر بعض الشروط التي منها ما يتعلق بصاحب البراءة و منها ما يتعلق بطالب الترخيص الإجباري ،و في الأخير وضع المشرع الجزائري إجراءات للحصول على الترخيص الإجباري ،ففي القوانين القديمة أعطى الإختصاص للجهات القضائية ،أما في القانون 03/07 فقد أعطى الإختصاص للجهات الإدارية . Abstract : Despite the right of the patent holder, to exploit the invention in a manner that prevents, the third party from exploiting the invention without his consent, The legislator has approved a compulsory license to exploit the patent, regardless of its owner, if there are certain cases of non-exploitation of the invention, the lack of such exploitation by the patent owner or the associated inventions, and also the case of compulsory license for the public benefit, In order to grant the compulsory license, some conditions must be met, including the patent owner, including the compulsory license. Finally, the Algerian legislator set out procedures for obtaining the compulsory license. In the old laws, jurisdiction was given to the judicial authorities 03/07 gave the specialization to the administrative bodies
