العلاقة بين المحكمة الدولية والدول الاطراف وفق نظام روما الأساسي

Résumé: ملخص: يهدف اقرار مبداي التكامل و التعاون في النظام الاساسي للمحكمة الجنائية الدولية الى منع الافلات من المسائلة الجنائية، و تعزيز التعاون بين الدول من اجل مكافحة اكثر الجرائم خطورة على المجتمع الدولي، كما يعتبران مبدان أساسيان في ابراز مكانة المحكمة الجنائية الدولية في المجتمع الدولي، حيث ان المحكمة لا تتمتع بجهاز تنفيذي يسهر على تنفيذ قراراتها و احكامها، و انما تعتمد في ذلك على تعاون الدول الاطراف معها. وما يدعم هذا التعاون الاختصاص التكميلي للمحكمة ، كونها امتداد للنظام القضائي للدول الاطراف تنفذ قراراتها من خلال الاجهزة القضائية للدول الاطراف وبالتعاون بينها و بين الدول. Abstract: The objective of the enshrining of the principles of integration and cooperation in the Status of the International Criminal Court is to prevent impunity from criminal responsibility and to promote cooperation between States in order to fight against the most serious crimes against the international community; They are also fundamental principles in highlighting the status of the International Criminal Court in the international community, as the Court does not have an executive body that ensures the implementation of its decisions and judgments, but relies on the cooperation of States parties. This cooperation is supported by the complementary jurisdiction of the Cour, as it is an extension of the judicial system of States Parties, implementing its decisions through the judicial organs of States Parties and in cooperation between them and States.
