النظام القانوني للتأمين التكافلي "في ظل المرسوم التنفيذي الجديد رقم 21-81"

Résumé: تتطرق الدراسة للنظام القانوني للتأمين التكافلي في الجزائر الذي بدأ بصفة غير دقيقة المعالم في صورة المرسوم التنفيذي رقم 09-13 المتعلق بالشركات التعاضدية، لينتقل إلى التشريع له من خلال مادة وحيدة "203 مكرر" تممت الأمر رقم 95-07 المتعلق بالتأمينات المعدل والمتمم، وتطبيقا لأحكام هذه المادة حظي التأمين التكافلي بعد ما يزيد عن السنة بالمرسوم التنفيذي رقم 21-81، المحدد لشروط وكيفيات ممارسة التأمين التكافلي، كتنظيم قانوني خاص بهذا النوع من التأمين لأول مرة في الجزائر. Abstract: The study deals with the legal system of Takaful insurance in Algeria, which appeared inaccurately defined in the form of the executive decree n° 09-13 related to mutual companies, to move to the legislation for it through a single article 203 bis, that completed order N° 95-07 related to modified and supplemented insurances and in implementation of the provisions of this article, the Takaful insurance was granted after more than one year by executive decree n°21-81, specifying the conditions and modalities for practicing Takaful insurance, As a legal regulation for this type of insurance for the first time in Algeria.
