توقيف الطفل للنظر وفقا للقانون الجزائري

Résumé: تقتضي مرحلة البحث والتحري اللجوء إلى إجراءات منها ما يمس بحرية الأفراد، كإجراء التوقيف للنظر الذي يعد أخطر إجراء كونه يقيد من حرية الفرد، وما يزيده خطورة عندما يكون الشخص الموقوف للنظر طفلا ، نظرا لصغر سنه وعدم نضجه وعدم قدرته على تحمل تبعات ذلك الإجراء، ومراعاة لذلك فقد أفرد المشرع الجزائري قانونا خاصا تمثل في القانون 15 -12 المؤرخ في 15/ 70/ 2015 المتعلق بحماية الطفل ،نص فيه على ضمانات تختلف عن تلك المقررة للشخص البالغ المنصوص عليها في قانون الإجراءات الجزائية عند اتخاذ إجراء التوقيف للنظر، وذلك بتحديد مدة الإجراء وكيفية تمديدها، وسن الطفل ونوع الجرائم التي يجوز توقيفه فيها، بالإضافة إلى تكريس بعض الحقوق، كحق الدفاع والفحص الطبي وحق الاتصال بالأسرة والمحامي وغيرها من الحقوق التي وردت في هذا القانون الخاص. The stage of research and investigation requires resorting to procedures, including those that affect the freedom of individuals, such as the procedure of arrest for consideration, which is the most dangerous procedure as it restricts the freedom of the individual, and what increases it risk when the person arrested for consideration is a child, given his young age, immaturity and inability to bear the consequences of that procedure, and taking into account that The Algerian legislator has singled out a special law represented in Law 15-12 of 15/07/2015 relating to the protection of the child. The age of the child and the type of crimes for which he may be arrested, in addition to enshrinement of some rights, such as the right to defense, medical examination, the right to contact the family and a lawyer, and other rights mentioned in this special law.
