خصوصية محاكمة الأحداث في ظل القانون 15/12 المتعلق بحماية الطفل

Résumé: تتناول هذه الورقة البحثية موضوعا مهما، يتعلق بالخصوصية التي تتميز بها مرحلة محاكمة الأحداث في التشريع الجزائري، وفقا للقانون 15/12 المتعلق بحماية الطفل، فبما أن قضايا الأحداث من المسائل ذات الطابع الاجتماعي أكثر منها ذات طابع جنائي ، فإن المشرع الجزائري قد أولاها اهتماما كبيرا وعناية خاصة ، بأن جعل سياسة محاكمة الأحداث قائمة على أسس ومبادئ مختلفة عن تلك التي تتبع في محاكمة الأشخاص البالغين، فخصها بجهات خاصة للنظر، سواء من حيث تشكيلتها أو اختصاصها أو سير المحاكمة أمامها، أو حتى تدابير الحماية والتهذيب والعقوبات المقررة للطفل الجانح . Abstract. This study explores the specificities characterizing the course of minors’ trials in the Algerian legislation according to the 12/15 Act concerning child protection. The Algerian legislator gives juveniles’ trials great attention and care mainly because of their aspect, which leans more towards the social side more than it does towards the criminal one. For that matter, other basics and principles were devised to set the course of those trials apart from the adults’ .this includes establishing other specialized examination bodies, each with its own composition, specialty and the way trials are to be held before them, and also the protection, disciplinary and punishment measures determined on the delinquent child.
