المخدرات والمؤثرات العقلية في الجزائر: قراءة في النصوص التشريعية والتنظيمية Drugs And Psychotropic Substances In Algeria: Review Of Legislative And Regulatory Legal Texts

Résumé: ملخص: شهد المجتمع الجزائري انتشارا مهولا للمخدرات والمؤثرات العقلية في العشريتين الأخيرتين على الخصوص، شمل كل الأوساط والفئات الاجتماعية، فـي كل الجهات والمناطق الجغرافية، نظرا لعوامل اقتصادية واجتماعية داخلية من جهة، وأخرى دولية وإقليمية من جهة أخرى، الوضع الذي اضطر السلطات العمومية إلى المسارعة إلى سن ترسانة من النصوص القانونية التشريعية والتنظيمية بهدف بسط الرقابة على المخدرات والمؤثرات العقلية فـي الجزائر، وتنظيم التعامل المشروع بها وقمع الاستعمال غير المشروع لها، لأجل الحد من تداعياتها الخطيرة على الصحة العمومية والاستقرار المجتمعي. فـي هذا السياق يندرج البحث موضوع هذا المقال، الذي يروم استعراض كل النصوص القانونية التشريعية والتنظيمية ذات العلاقة بالمخدرات والمؤثرات العقلية، ومحاولة تقديم قراءة متفحصة موجزة لها، ثم تسليط بعض الضوء على واقع المخدرات والمؤثرات العقلية في المجتمع الجزائري، من خلال استعراض بعض الإحصائيات الرسمية والتعليق عليها. وقد انتهج فـي البحث، موضوع هذا المقال، المنهج الاستقرائي لاستقراء النصوص، والمنهج التحليلي للتعليق على النصوص والإحصاءات. Abstract: Algerian society has witnessed a dramatic proliferation of drugs and psychotropic substances in the last two decades in particular, involving all social circles and groups, in all regions and geographical areas, due to internal economic and social factors on the one hand, and international and regional factors on the other, the situation has forced public authorities to rapidly enact an arsenal of legislative and regulatory legal texts with the aim of extending control over drugs and psychotropic substances in Algeria, regulating their legitimate dealings and repressing their illegal use, in order to reduce their dangerous repercussions on public health and social stability. In this context, falls the research subject of this article, which aims to review all legislative and regulatory legal texts related to drugs and psychotropic substances, and try to provide a brief examination of them, and then shed some light on the reality of drugs and psychotropic substances in Algerian society, by reviewing and commenting some official statistics. The research, subject of this article adopted the inductive method to extrapolate texts and the analytical method to comment texts and statistics.
