مسؤولية موظف الإدارة عن عدم تنفيذ الأحكام القضائية الصادرة عن القضاء الإداري

Résumé: ملخص: إن الغرض من هذه الدراسة هو تقديم وصف تحليلي حول مدى مسؤولية موظف المرفق العام جراء الامتناع عن تنفيذ الأحكام والقرارات الإدارية الصادرة عن القضاء الإداري، وذلك من خلال تسليط الضوء على أهم عناصر هذه المسؤولية وأنواعها، حيث لا يقتصر دور القضاء في الدولة الحديثة على مجرد إصدار حكم أو قرار يؤكد أحقية صاحب الحق، بل يمتد ليشمل عملية التنفيذ لا سيما أمام حجية الشيء المقضي فيه. وقد خلصت الدراسة إلى إبراز أهم النتائج والتوصيات المتوصل اليها في مجال دراسة الموضوع، لا سيما الحلول المقترحة لهذا الامتناع، ومن ثم الحد منه. Abstract: The purpose of this study is to provide an analytical description about the extent of the public utility employee’s responsibility as a result of refraining from implementing administrative judgments issued by the administrative judiciary, by highlighting the most important elements and types of this responsibility, as the role of the judiciary in the modern state is not limited to just issuing A judgment confirming the eligibility of the right holder, but rather extends to the implementation process, especially in the presence of the authority of the thing decided. The study concluded by highlighting the most important results and recommendations reached in the field of study of the subject, especially the proposed solutions to this refrain, and then limit it.
