التدابير الوقائية لحماية الزوجين من الخيانة الزوجية في الشريعة الإسلامية والقانون الجزائري
Résumé: تهدف هذه الدراسة إلى تبيان مدى حرص الشريعة الإسلامية، وكذا القانون الجزائري على تحصين الزوجين من الوقوع في الخيانة الزوجية، فكان لنا ذكر لمجموعة من أنواع التدابير الوقائية التي تحمي الميثاق الغليظ بين الزوجين التي ان التزما بها، فستكون عونا لهما على الوقوع في براثن جريمة الخيانة. وقد خلصت الدراسة إلى أن الشريعة الإسلامية من خلال أوامرها ونواهيها، أكثر حرصا وتعدادا لمجموعة التدابير الوقائية التي تحمي الزوجين من الوقوع في الخيانة الزوجية، لأن الشريعة الإسلامية تقوم على مبدأ الوقاية خير من العلاج، أما القانون الوضعي فيعتمد على إيقاع العقوبة بعد وقوع الجريمة. The purpose of this study is to emphasize the keenness of Islamic law as well as Algerian law in protecting spouses from falling into infidelity. The paper highlights a set of preventive measures that aim at protecting the sacred contract between spouses; committing to these measures prevents spouses from falling into infidelity. The study concludes that Islamic law is considered to be the most attentive to these preventive measures by stipulating numerous commands and inhibitions that protect spouses from falling into infidelity. Islamic law is based on the principle: “prevention is better than cure,” whereas positive law imposes punishment after the crime has occurred.
