العلاقة بين القانون الدولي الانساني و القانون الدولي لحقوق الانسان

Résumé: لقد نتج عن تطور القانون الدولي ظهور فروع جديدة الى جانب الفروع الكلاسيكية -التي تمثلت أساسا في تطبيقات القانون الدولي في زمن النزاعات المسلحة كمرحلة أولى غالبة على جميع العلاقات الدولية- الى تداخل بين فروعه لا سيما القانون الدولي الانساني و القانون الدولي لحقوق الانسان هذا الأخير الذي ظهر كمرحلة ثانية في العلاقات الدولية بسبب ما خلفته المرحلة الأولى من خراب و تدمير للدول،وبالرغم من اختلاف مجال تطبيقهما و طبيعتهما إلا أنهما يتشابهان الى حد كبير في العديد من النقاط التي ستكون موضوع دراستنا. the evolution of the international law has resulted in an emergence of new branches beside the classical ones- which is basically represented in its applications in the armed conflicts as a first stage overriding all international relations- and overlaping between its branches especially the international humanitarian law and the human rights laws,this latter that appeared as a second stage in the international relation because of what the first stage has left of devastation and destruction behind the nations. Despite Their Difference in Application and naturethey are, to a great extent, similar in many points which will be the theme of our study.
