دور القاضي في تطهير الملكية العقارية الفلاحية غير الممسوحة

Résumé: يكتسي العقار الفلاحي أهمية بالغة على الصعيد الإقتصادي والإجتماعي بإعتباره مصدر للدخل القومي من جهة وللإستتمار الخارجي من جهة الثانية ،ولهذا السبب حاول المشرع الجزائري تطهير ملكية هذا نوع العقار الغير ممسوح من خلال إنشاء أجهزة متخصصة للقيام بهذه المهمة ،لكن بموازاة ذلك كان للقضاء دور هام في تطهير الملكية العقارية الفلاحية الغير ممسوحة و إن كان ذلك بطريقة غير مباشرة ،وهذا من خلال الأحكام التي تصدرها في دعوى المتعلقة بتثبيت الملكية العقارية سواء كان ذلك بوجود سند أو بدونه عن طريق الحيازة والتقادم المكسب. وعليه ما هو الدور الذي يلعبه القاضي في تطهير الملكية العقارية الفلاحية،وإلى أي مدى نجح في ذلك ؟. Agricultural real estate is extremely important economically and socially as a source of national income on the one hand and external investment on the other hand, and for this reason the Algerian legislator tried to purify ownership of this type of non-surveyed real estate by creating specialized agencies to do this task, but in parallel to that the judiciary had an important role in Purging the unauthorized agricultural real estate property, even if that is in an indirect way, and this is through the rulings it issues in a lawsuit related to establishing real estate ownership, whether with or without a bond through possession and obsolescence. Accordingly, what role does the judge play in clearing farm property ownership, and to what extent has he succeeded in this?.
