من مدارس المذهب المالكيّ: المدرسة العراقيّة، والمدرسة المغربيّة

Résumé: يعتبر المذهب المالكيّ أحد المذاهب الفقهيّة السنيّة الّتي انتشرت في كثير من أقطار العالم الإسلاميّ، ونظرا لتعدّد المدارس داخل المذهب - المدرسة المدنيّة، المدرسة المصريّة، المدرسة العراقيّة، المدرسة المغربيّة، المدرسة الأندلسيّة - ، كان الإختيار لتناول مدرستين هما المدرسة المالكيّة العراقيّة، والمدرسة المالكيّة المغربيّة، مُمهّدا لذلك بذكر الأصل الجامع لها وهو الكتاب والسنّة، ثمّ التطرّق لذكر نشأة المدرسة العراقيّة، وأبرز خصائصها، مُثنّيا بذكر نشأة المدرسة المغربيّة وأبرز خصائصها، لأَصِل إلى مظاهر التّكامل بين المدرسة العراقيّة والمدرسة المغربيّة في صورة الرحلات المتبادلة بينهما، والعناية بمؤلّفات كل منهما، وهذا ما يُوقفنا على كثير من أسباب الخلاف في المسائل الفقهيّة، ما يُعين الباحث في ترجيح الأقوال مع التماس العذر لما يراه مرجوحا. The Maliki school is considered one of the Sunni schools of jurisprudence that has spread in many countries of the Islamic world. In preparation for that, by mentioning the comprehensive origin of it, which is the book and the Sunnah, then addressing the mention of the emergence of the Iraqi school, and its most prominent characteristics, while mentioning the emergence of the Moroccan school and its most prominent characteristics, in order to reach the manifestations of integration between the Iraqi school and the Moroccan school In the form of mutual trips between them, and attention to the writings of each of them, and this is what stops us on many of the causes of disagreement in jurisprudential issues, which helps the researcher in weighting statements while seeking an excuse for what he deems likely.
