الوسائل الإجرائية الدولية لقمع الانتهاكات الجسيمة لقواعد القانون الدولي الإنساني

Résumé: إن تطور المفاهيم الإنسانية في المجتمع الدولي، وظهور العديد من المنظمات الدولية الإنسانية جعل من الضروري العمل على إبلاء مسألة احترام قواعد القانون الدولي الإنساني وقت النزاعات المسلحة العناية الخاصة، إذ ظهرت الدعوة إلى تفعيل مبدأ الالتزام بقمع الانتهاكات الجسيمة لقواعد القانون الدولي الإنساني، وردعها من خلال إرساء الوسائل الإجرائية الدولية لقمع هذه الانتهاكات. وتهدف هذه الدراسة إلى بيان إجراءات وآليات تحقيق واجب ملاحقة مقترفي الانتهاكات الجسيمة لقواعد القانون الدولي الإنساني، وهو الأمر الذي يتجسد من خلال الإجراءات الواجب اتخاذها لمواجهة الانتهاكات الجسيمة سواء ما تعلق منها بآليات التعاون الدولي في هذا المجال، أو بتفعيل دور القضاء الجنائي الوطني والدولي لمواجهة هذه الانتهاكات. The evolution of humanitarian concepts in the international community, and the emergence of many international humanitarian organizations, have made it necessary to pay special attention to respect for the rules of international humanitarian law in times of armed conflict. The principle of obligation to suppress and deter gross violations of the rules of international humanitarian law that has been called for through the establishment of international procedural means to suppress such violations. The study aims to establish procedures and mechanisms to ensure that perpetrators of grave violations of the rules of international humanitarian law are prosecuted. This is reflected in the measures that must be taken to address grave violations, whether they are related to mechanisms for international cooperation in this field, or the activation of the role of national and international criminal courts to confront such violations, suppress perpetrators and prevent impunity.
