الانتهاكات الجسيمة للقانون الدولي الإنساني:" آليات القمع وتحديات الواقع"

Résumé: نتيجة للانتهاكات الجسيمة للقانون الدولي الإنساني وإفلات الجناة من العقاب، ظهرت حتمية التعاون الدولي لقمع هذه الانتهاكات من خلال عدة آليات لمتابعة مرتكبي هده الانتهاكات الجسيمة، سواء بمحاكمتهم أمام محاكمهم الوطنية أو عن طريق تسليمهم لمحاكم دول أخرى في إطار التعاون القضائي الدولي، أو تسليمهم للمحاكم الدولية الجنائية، هذه الأخيرة لعبت دورا فعالا في متابعة مجرمي الحرب، رغم العوائق و التحديات المتعددة التي كشفت عنها الممارسة العملية، و التي تقف حائلا دون تعاون الدول في قمع الانتهاكات الجسيمة للقانون الدولي الإنساني، سواء كانت هذه العوائق سياسية كتحجج الدول بمبدأ السيادة، أو قانونية كرفض الدول الالتزام بالتعاون مع المحاكم الدولية الجنائية. As a result of the gross violations of international humanitarian law and the impunity of the perpetrators, the imperative of international cooperation to suppress these violations has emerged through several mechanisms to follow up on the perpetrators of these grave violations, whether by trying them before their national courts or by handing them over to the courts of other countries within the framework of international judicial cooperation, or handing them over to international courts. The latter played an effective role in pursuing war criminals, despite the multiple obstacles and challenges revealed by the practice, which hinder the cooperation of states in suppressing serious violations of international humanitarian law, whether these obstacles are political, such as states' invocation of the principle of sovereignty, or legal As states refuse to commit to cooperate with international criminal courts.
