مسؤولية إسرائيل عن الانتهاكات الجسيمة التي تلحق بالبيئة الطبيعية في الأراضي الفلسطينية المحتلة

Résumé: الحفاظ على البيئة الطبيعية عنصر أساسي لحياة الكائنات الحية بما في ذلك الإنسان، فحماية البيئة الطبيعية تكفل تعزيز الحقوق الأساسية للإنسان، إذ لم يعد يكفي أن يبقى الإنسان حيا، بل أن حق الحياة أكبر وأوسع من أن يختصر ببقاء الإنسان على قيد الحياة، وهذا ما يتنافى مع واقع الانتهاكات الإسرائيلية لأحكام حماية البيئة الطبيعية في الأراضي الفلسطينية المحتلة من تلويث مصادر المياه وتدمير لمصانع التغذية والأراضي الزراعية وغيرها من مصادر البيئة الطبيعية التي تضمن بقاء الإنسان الفلسطيني واستمراره، من ثم تترتب المسؤولية المدنية في مواجهة الكيان الإسرائيلي والمسؤولية الجزائية في مواجهة قادته العسكريين الذين انتهكوا قواعد حماية البيئة الطبيعية بالأراضي الفلسطينية المحتلة، ولا يمكن دفع هذه المسؤولية القانونية بالضرورة العسكرية أو كما يطلق عليها الكيان الإسرائيلي الدواعي الأمنية ولا الاحتجاج بعدم الانضمام للاتفاقيات المتعلقة بحماية البيئة، لأن العيش في بيئة سليمة أهم حق للإنسان لذا يفترض احترامها في جميع الأوقات سواء في زمن السلم وزمن الحرب Preservation of the natural environment is an essential element in the life of living beings, including humans. The protection of the natural environment guarantees the promotion of the fundamental rights of man. It is no longer sufficient for a human being to live, but the right to life is greater and broader than that of human survival. With the reality of the Israeli violations of the provisions of the protection of the natural environment in the occupied Palestinian territories from the pollution of water sources and the destruction of feeding plants, agricultural lands and other sources of the natural environment that ensure the survival and continuity of Palestinian human rights. And the criminal responsibility in the face of its military commanders who violated the rules of protection of the natural environment in the occupied Palestinian territories. This legal responsibility can not be imposed on military necessity or as the Israeli entity calls for security reasons or protest against non-adherence to environmental protection agreements. Is supposed to be respected at all times, both in time of peace and of war.
